Judge drops charge against Texans' Weary

112206_weary.jpgA charge of resisting arrest against Houston Texans offensive lineman Fred Weary were dropped yesterday after a judge said Weary didn't use enough force during a traffic stop to justify the charge.

Weary, remember, was Tasered by an HPD officer last week when he was pulled over on the West Loop; police said he was verbally combative, refused to turn over his license, pushed away handcuffs and stepped toward one of the cops, which was when he got shocked. "There was no crime here," Weary's attorney, Charley Davidson, said after yesterday's hearing. "He didn't do anything illegal. He didn't deserve to be Tasered."

It's not over yet, though, apparently: County prosecutor Paul Doyle said Judge Pam Derbyshire relied on statements from the police officers to make the call to drop charges yesterday, but the DA's office will review radio calls from the officers to see if it can figure out exactly what happened. "For now, it's dropped," Doyle said.
