<description>&lt;p&gt;Yeah, the issue here is that Weingarten knows better than to build in the setback, but apparently it has already done so — and the prevailing attitude in Houston is to build first and ask (and get) permission later. That&apos;s no good.&lt;/p&gt;</description>

<description>&lt;p&gt;I think it&apos;s fair to ask that - Shepherd is noisy by nature, but I think a patio used for private parties/other things will add some noise to the adjacent homes.  There&apos;s also the argument that these rich folks bought homes right next to retail, and the possibility of redevelopment is always there.  
Violating setbacks, however, isn&apos;t allowed, but now it is.  I somehow doubt the variance won&apos;t be granted, especially since Weingarten has already gone forward.&lt;/p&gt;</description>
